TERRIBLE NEWS: Friday, 25 July 2014 


Save Williamstown and community members spent 25 days this year and 30 last year in VCAT speaking the TRUTH against expert witnesses paid by the developer to present evidence supporting the developer's case.


WE WERE SHAFTED BY THE WEALTH OF THE DEVELOPER......


Basically the Tribunal has decided to tell Hobsons Bay Council to issues permits to:


  1. Demolish the heritage Nugget Factory and 

  2. Allow a 34 m 10 storey apartment building towering over Cecil St heritage homes.

  3. Apartment building walls to be strengthened because the tower building is too close to the Pt Gellibrand Major Hazard Facility. Unbelievably the developer’s expert calculation of 3.5 kPa was chosen by VCAT instead of the 5 to 8 kPa level calculated by Worksafe. One person against a team of government experts.

  4. Also allowed 10 townhouses to built in an area which Worksafe said is not suitable for residents as they are incapable of evacuating in an emergency.

  5. Allow many other townhouses within the 400m Boilover Distance of the Crude Oil Major Hazard Facility - as explained by Mobil to the Advisory Committee and Council

  6. AND   DESTROY forever the Heritage St Precinct of Cecil St.

THIS IS THE BLACKEST DAY IN THE HISTORY OF WILLIAMsTOWN AND A STUPID PLANNING DECISION

Stage 3 bringing the total development to 800 dwellings with 2000 new people will be a lay down mezare - unless the ALP and Greens can reimpose height controls after 29th December Election when hopefully Matthew Guy will no longer be Minister for Planning!

 

Hobsons Bay Council will be forced by this VCAT decision to issue permits. 

HOBSONS BAY COUNCIL is held responsible even though VCAT made the decision....


If anything goes wrong in the future it is ALL the ratepayers of Hobsons Bay who will have to pay damages in any future class actions. It has happened before with the City of Casey.  Leakages from Land Fill caused residents to move out of their new homes and the ratepayers of Casey & the EPA had to pay damages to residents.  If there is ever any incident at this site, Hobsons Bay ratepayers will be paying damages if liability is proven.. VCAT divests itself of all responsibility as does the applicant.


Another huge question for local industry, with so many people living so close to the importation of heavy crude oil at Pt Gellibrand, how long will Mobil be able to continue operating a refinery at Altona?

This is the worst planning decision VCAT has ever made.....
